In compliance with the Company’s obligations to provide paid sick and safe time (PSST) to certain covered gig workers under the City of Seattle’s Gig Worker Paid Sick and Safe Time Ordinance (Ordinance), covered Drivers will be provided with PSST during the civil emergency related to COVID-19, as provided under this policy. The Company will comply with all applicable requirements of the Ordinance.

Reasons for Use

Covered Drivers may use PSST for any reason covered by the Ordinance, including:

  • To care for yourself or a family member for a physical or mental health condition, including a doctor’s appointment.
  • To care for yourself or a family member for reasons related to domestic violence, sexual assault or stalking.
  • When your family member’s school or place of care has been closed.
  • When the company reduces, suspends or discontinues operations by order of public official, for any health or safety related reason, to limit exposure to an infectious agency, biological toxin or hazardous material.
  • When the company reduces, suspends or discontinues operations for health or safety related reasons.

PSST may only be used in 24-hour increments.

Eligibility

Drivers who perform work, or make a work-related stop, for Zum in whole or part in the City of Seattle are covered under the Ordinance. However, Drivers are only entitled to use PSST if they have taken at least 1 trip for Zum in the City of Seattle in the last 90 calendar days prior to the Driver’s request to use PSST.

Accruing and Using Paid Sick and Safe Time

All Covered Drivers began accruing PSST as of October 1, 2019, or on the date that they gave their first Seattle ride (whichever is later). Subject to the eligibility requirements summarized above, Covered Drivers will accrue and can use PSST until 180 days after the termination of the civil emergency proclaimed by the Mayor on March 3, 2020, or the termination of any concurrent civil emergency proclaimed by a public official in response to the COVID-19 public health emergency, whichever is latest.

Any day in which you pick up or drop off a passenger in the City of Seattle is counted toward accrual of PSST. Covered Drivers will accrue one (1) day of PSST for every 30 calendar days they give a ride in the City of Seattle after October 1, 2019. These days do not have to be consecutive. Each day with at least 1 pick-up or drop-off in the City of Seattle counts toward accrual.

Covered Drivers can also carry over up to 9 days of accrued, unused PSST to the following calendar year.

Compensation for PSST is based on the average daily payout of your earnings on days in which you had at least one work-related stop in the City of Seattle during your highest earning calendar month since October 1, 2019, or since your commencement of work for Zum, whichever is later. This calculation includes all earnings related to your rides, including trip earnings and bonuses, and includes earnings for work performed in the City of Seattle and outside of Seattle (so long as you had at least one work-related stop in the City of Seattle on that day).

Covered Drivers can also carry over up to 9 days of accrued, unused PSST to the following calendar year.

Requesting Paid Sick and Safe Time

To request PSST:

  1. Submit a claim through our online portal - here.
  2. Fill in your email address and name.
  3. Select the date(s) for which you wish to request a PSST day(s) off.
  4. Click – Submit.

Your PSST will begin immediately after your request and ends 24 hours after your requested time is applied. Zum will notify you when the 24-hour PSST period ends. PSST is paid out as a bonus in your account on your next scheduled payout date, or within 14 days, whichever is earlier.

If you request more time than you have available to use, we will notify you via email within 10 days.

Covered Drivers will receive a monthly email stating (1) your current rate of average daily compensation for use of PSST, and (2) an updated amount of accrued, reduced, and available PSST since the last notification. Drivers who have not driven for Zum since the last notification will not receive another notification email.

Anti-Retaliation

Covered Drivers have the right to request and use PSST under the Seattle Gig Worker Paid Sick and Safe Time Ordinance. Discrimination or retaliation against a Covered Driver for exercising any of their rights provided by the Ordinance, including the use of PSST, is prohibited.
